1. The highest bidder shall be the Purchaser and in the event of dispute the Auctioneer shall have absolute discretion to settle it or to re- offer the lot.
2. The Auctioneer may without giving any reason refuse to accept the bidding of any person or persons.
3. No person may advance less at a bid than a sum to be named from time to time by the Auctioneer.
4.The Vendors may bid for any lot or lots, and may withdraw any lot or lots either personally or through the Auctioneer or any other person as many times s they may respectively think fit.
5. All lots shall be paid for in cash, eftpos or cheque immediately after the sale, on the day of the sale.
6. Each lot shall be put up for sale as exhibited, with all faults and errors of description and neither the Vendor nor the Auctioneer shall give any warrant to any Purchaser or be liable for any fault or error of description or lack of genuineness or authenticity of any lot or item in any lot. Purchasers shall accept every lot with all faults and errors of description whether or not any lot or item in any lot is exhibited in any type of container or packaging and whether or not the lot itself or the container or packaging is exhibited with any label, certificate of opinion, other supporting sticker or documents and embossed with any printing or mark.
7. All appliances and equipment whether electrical or battery operated are to be bid for, purchased and taken as the same now stand and in their present position and condition with and subject to all faults and defects whatsoever.
Neither the Vendor nor the Auctioneer will be liable for any personal injury, damage, loss or expense suffered, caused or incurred in the use of or as a result of any appliance or equipment or in the installation thereof.
8. Machinery, timber, plant or other property are to be bid for and purchased and taken as the same now stand and in their present position and condition with, and subject to all faults, damages and defects whatsoever.
Purchasers must satisfy themselves that the measurements specified are correct. Any deficiency in the quantity described shall not invalidate the sale and neither the Auctioneer nor the Vendor shall be bound to deliver more than is in their possession.
9. All lots will be at the purchasers risk immediately after the fall of the hammer and no responsibility will be incurred by the Auctioneer or the Vendor for their safekeeping. No exception shall be taken for any of the lots on delivery, the whole having been open for inspection by the purchaser prior to the sale and on no account will any allowance be made.
10. All lots shall be removed by the Purchaser at the Purchaser's risk and expense either:-
a. Immediately after the sale; or
b. At such later time as the Auctioneer may nominate:
But in either case only upon presentation to the Auctioneer or his representative of the delivery docket for all lots purchased by the Purchaser with receipts for payment endorsed thereon. If the lots are not removed in accordance with this condition then without prejudice to any other rights of the Auctioneer or Vendor, and lots not so removed may be stored by the Auctioneer or Vendor at the expense of the Purchaser either at the Auctioneers store or elsewhere and such storage shall be deemed to have been made by the Auctioneer at the request of the Purchaser.
11. The Auctioneer gives no warranty as to the Vendors title to the goods.
12. The Auctioneer acts in the sale of goods as agent only, and is not responsible for any default by either Vendor or Purchaser.
13. The Auctioneer accepts no responsibility in connection with the commissioning of its staff to bid for any lots. Reserves and commissions given by telephone are accepted at Senders risk and must be confirmed in writing before the date of sale. No lot may be transferred.
14. Every person on the auction premises before, during or after the sale shall be deemed to be there at his own risk and with notice of the conditions of the premises. Such person shall have no claim against the Auctioneer in respect of any injury sustained or accident which may occur from any cause whatsoever.
15. If the Purchaser shall breach these terms and conditions in any way any lots purchased by him may be resold by public auction or private contract at the risk and expense of the former purchaser who shall be held liable for any deficiency that may arise from such resale together with all costs incurred. Any deposit paid by the Purchaser may be forfeited to the Vendor upon breach by the Purchaser.
16. Any stamp duty payable on goods sold at the Auction shall be paid by the Purchaser.
17. Legal and equitable title to the goods shall remain with the Vendor until payment has been made in full.
18. The knockdown of any item sold will be INCLUSIVE of any GST that may apply. No GST shall be added to the knockdown price unless otherwise stated
19. All knockdown prices will be subject to a Buyers Premium of 10% unless otherwise noted. This fee is to be paid by the purchaser / buyer of each item.
20. By our acceptance of a bidder's card or by bidding at a Town and Country Auction you agree to accept and abide by all said Terms and Conditions listed here or as otherwise noted on the day of the sale.
21. Commissions rates are as follows (subject to change): Horses 8.8%, Saddles 10%, Sundries 15%, Large valued items such as trailers, caravan, tractors etc by arrangement starting at 5.5% depending on value
